Before a result appears here, we verify the amount, the year, the jurisdiction, and our firms’ actual role in the case, because our editorial policy does not allow us to publish figures we cannot stand behind.
Plenty of birth injury websites display walls of eight-figure “results” that are borrowed from other firms, aggregated from public verdict reports they had nothing to do with, or simply unverifiable. We would rather show you a truthful page under construction than a polished page that misleads.
What actually determines a birth injury case’s value
While the results are being verified, here is something more useful than a highlight reel: the factors that genuinely drive what a birth injury case is worth.
- The severity and permanence of the injury. A brachial plexus injury that resolves with therapy and a lifelong cerebral palsy diagnosis are different cases by orders of magnitude.
- The lifetime cost of care. The largest component of most serious birth injury recoveries is the life care plan: a professional projection of every therapy, surgery, device, medication, and hour of attendant care the child will need.
- Lost earning capacity. Compensation can account for the work a child will be unable to do as an adult because of the injury.
- The strength of the liability evidence. What the medical records show about what was done, when, and against what standard of care.
- State law. Damage caps, filing deadlines, and procedural rules vary by state and can materially change an outcome.
